A custom order contains three or four approval gates \u2014 artwork, sample, pre-production sample, first article \u2014 and each one stops production until someone with authority signs. This is the single most consequential fact about private labelling and it is routinely discovered after the first container arrives rather than before the order is placed. It is not a reason to avoid private labelling \u2014 it is a reason to plan for it, price it, and agree in writing what documentation the factory will supply to support it.<\/p>\n\n\n\n<p>In the European Union, the framework for product rules \u2014 Regulation (EC) No 765\/2008 and the European Commission&#8217;s Blue Guide on the implementation of EU product rules \u2014 provides that where an importer or distributor places a product on the market under his own name or trademark, or modifies it, he takes over the manufacturer&#8217;s responsibilities, including responsibility for affixing any conformity marking. The General Product Safety Regulation carries an equivalent provision: a party placing a product under its own name or trademark is deemed the manufacturer and the manufacturer&#8217;s obligations apply to it.
